By placing an order at Sonya Moda, you warrant that you are at least 18 years old (or have parents' permission to buy from us) and accept these terms & conditions which shall apply to all orders placed or to be placed with Sonya Moda for the sale and supply of any products. None of these terms & conditions affect your statutory rights. No other terms or changes to the terms & conditions shall be binding unless agreed in writing signed by us.

We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

FAULTY ITEMS
A faulty item claim must be made within 2 days of receiving your goods. For faulty garments, please email your invoice number along with photos of the fault to customercare@sonya.moda
Worn items will not be accepted for a faulty claim. If a fault does not amount to major failure in the garment, we are entitled to elect between providing you with a repair, replacement or other remedy. Products that have a major fault or manufacturing fault may be returned for a replacement, exchange or a credit note. For products with minor faults, we can offer to repair these for you. This policy does not exclude or replace your rights under any applicable law.
PERSONAL INFORMATION
All personal information you provide us with or that we obtain will be handled by Sonya Swim as the data ‘controller’ responsible for the personal information.
The personal information you provide will be used to ensure deliveries to you, conduct credit assessment if required and to provide offers and information on our catalog to you.
You have the right to inspect/modify the information held about you.You always have the right to request Sonya Moda to delete or correct the information held about you.
By accepting the Sonya Moda conditions, you agree to the above.

PAYMENT
All products remain Sonya Moda's property until full payment is made. The price applicable is that set at the date on which you place your order. Shipping costs and payment fees are recognized before confirming the purchase. If you are under 18 years old you must have parents' permission to buy from Sonya Moda.
All transfers conducted through Sonya Moda are handled and transacted through third party dedicated gateways to guarantee your protection. Card information is not stored and all card information is handled via SSL encryption means.
Please read the terms & conditions for the payment gateway chosen for the transaction as they are responsible for the transactions made.
LOCAL TAXES
Please note that local charges (sales tax, customs duty) may occur, depending on your region and local customs duties. These charges are at the customers own expense. All parcels which reject customs payable and reverted back to us will incur a $20AUD return to sender fee.
MOBILE TERMS OF SERVICE
The SONYA mobile message service (the "Service") is operated by Sonya Moda (“Sonya Moda”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Sonya Moda’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Sonya Moda through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Sonya Moda. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to Sonya Moda or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Sonya Moda mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

ADDITIONAL INFORMATION
SONYA reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice. At the event of when a product is sold out, Sonya Moda has the right to cancel the order and refund any amount paid in the best way. Sonya Moda shall also notify the customer of equivalent replacement products if available.
Shopify is not responsible for any content, interactions or transfers made on Sonya Moda websites.
PREORDER ITEMS
Preorder items are shipped together with non preorder items once we can fulfill your entire order. If you require an item prior to your preorder in-stock please place a separate order.
Estimated shipping dates are provided as a guide as in some cases production and/or shipping delays may occur.
GIFTED ITEMS
In the instance you are gifted an item and the original order has been returned without the gifted item, you will be charged the RRP of the gifted item which will be deducted from your balance of your store credit.
